High Court Judge William Musyoka has cleared the way for the FKF Premier League fixture between Mara Sugar and Gor Mahia to proceed, effectively lifting the suspension that had temporarily halted the match. In a ruling delivered on Monday, 25 May 2026, at Milimani Law Courts in Nairobi, Justice Musyoka certified the matter as urgent and granted FKF leave to institute a substantive judicial review case.
The court also issued a stay of the Sports Disputes Tribunal (SDT) orders that had earlier stopped the fixture, thereby allowing the match to go ahead. The judge directed that the substantive motion be filed within seven days, with responses to be filed thereafter. The matter will be mentioned on 3 June 2026 for further directions. In the interim, the court ordered that the SDT decision remain stayed.“The matter is certified urgent… there shall be a stay in terms of prayer 4 of the ex parte chamber summons,” the ruling stated.
Following the High Court decision, Gor Mahia confirmed that the fixture will now proceed in Homa Bay as initially directed.“As per the High Court order issued today, the pending match against Mara Sugar will proceed in Homa Bay, just as FKF requested in their petition filed yesterday,” FKF stated. “We will play our pending match against Mara Sugar tomorrow (Wednesday) in Homa Bay.”The fixture had earlier been thrown into uncertainty after Mara Sugar moved to the Sports Disputes Tribunal, which issued orders stopping the Sunday match pending the hearing of an appeal.

FKF’s Leagues and Competitions Committee rejected Wang’uru Stadium, arguing it was not an approved alternative venue and was more than 200 kilometres from the club’s registered home ground.
